Catergate.com is a trade name of Neil Robert Walton with address at c/La Paja 34, 29110, Monda, with NIE X5462189B and www.catergate.com as the internet domain where he provides services under the terms set out in these general conditions.
In the services in which the user must register and access is provided with a password, the user will be the only one responsible for keeping it private.
By using the website, the user declares his/her unreserved acceptance of these general terms and conditions and accepts the restrictions on the use of the services that may be imposed from time to time.
The user undertakes not to use the services for activities contrary to the law or public order and, in general, to use them in accordance with these general terms and conditions. The user also undertakes not to use these services for commercial or advertising purposes without explicit agreement or consent, and not to use false identities or impersonate the identities of other persons.
Part of Catergate.com activity may consist of advertising other companies, products and services but in no case can he assume any responsibility or give any guarantee or support for what he advertises, as it is understood that the responsibility for everything that an advertisement offers, or any type of commercial communication in general, must in any case be that of the advertiser.
Insults, incitement to violence or hatred, any action contrary to the rights of minors and children, the copying and distribution of material protected by copyright or copyright, the sending of unsolicited electronic mail [known as SPAM mail] or any similar type of communication, the extraction of personal data or other information or software from our computer systems and in general any other activity that is contrary to the law, considering that Catergate.com is governed by Spanish law. In the event that any user is found to be engaging in such prohibited activities, Catergate.com is free to take action such as preventing access to the offending user and terminating the user's accounts [including any outstanding payments if any], including, as appropriate, alerting the relevant authorities or taking legal action for compensation for the damage caused.
Catergate.com shall not be liable for any failure of communications, including deletion, incomplete transmission or delay in transmission, nor does it undertake that the transmission network will be operational at all times. Nor will it be liable in the event that a third party, in breach of security measures established by Catergate.com, accesses messages, places computer viruses or otherwise causes damage to the computer system that may impact on its users.
Catergate.com has adopted a personal data protection policy, including registration with the Data Protection Agency, but cannot guarantee the absolute invulnerability of its security systems, nor can it guarantee the security or inviolability of such data as it is transmitted over the network.
Although Catergate.com makes every effort to do so, Catergate.com cannot guarantee the legality, reliability and usefulness of the content and services, nor can it guarantee their truthfulness or accuracy.
Catergate.com will inform users and visitors to the website whether or not they are obliged to provide each and every one of the personal details requested in the forms for accessing and registering for the services and/or content offered on the website. The warning will be made at the time of collection through visual warnings such as floating windows, placement of asterisks or symbols next to the requested data, or analogous means to those mentioned above. In any case, the refusal to provide the requested personal data, the provision of inaccurate data or incomplete data may result in the inadequate, inefficient, defective or non-provision of the services and/or content offered to users and visitors.
Catergate.com does not control or guarantee the absence of computer viruses in the services provided by third parties that may cause alterations in your computer system [software and hardware] or in the documents and electronic files stored in your computer system.
Catergate.com may provide links to other websites as a supplement to its information and services. However, Catergate.com cannot be held responsible for information, products or services that can be found on Internet addresses that are not directly from Catergate.com.
Catergate.com has no means of monitoring users' use of the site, and therefore does not guarantee that they do so in accordance with these terms and conditions, although it will take the necessary measures in the event that such illegal activities are discovered, which may include the interruption of the service offered to the offender.
Catergate.com reserves the right to discontinue providing any of its services by giving fifteen days' notice in the same manner. Catergate.com also reserves the right to modify at any time and without prior notice, the presentation and conditions of the service, as well as the services and the conditions required for their use.
Catergate.com may, at any time, modify the present general conditions or introduce new conditions of use, including the cessation of free use of certain services.
The user accepts that the personal data provided or to be provided in the future to Catergate.com may be processed in a personal data file, in accordance with its personal data protection policy and the provisions of Spanish law in this regard.
The user, expressly waiving his or her own jurisdiction, accepts Spanish law as the governing legislation for these conditions and submits to the Courts and Tribunals of the city where Catergate.com has its headquarters for the resolution of any disputes that may arise from them.
How Catergate.com works
Catergate.com is an online marketplace for buying and selling services related to events, festivals, parties and weddings. Registered members can sell and book services through Catergate's online platform.
All prices quoted for services must be inclusive of VAT.
Anyone registered as a client can book services on Catergate.com.
Online Deposit Payment System
Clients wishing to cancel a service where a minimum of 30 days notice previous to the date of the event job has been given, will be eligible for a full refund on any deposit placed through Catergate.com.
In the case of a previously booked event service where a supplier cancels, the client is eligible for a full refund up to and including the date of the event.
Registered Users of the Marketplace
Any natural or legal person, Spanish or foreign, can use the Catergate platform to sell services related to events, festivals, parties and weddings. Interested parties must register and open their online account and profile. They will have to set up their payment methods. The website administrator reserves the right of admission to avoid market distortion.
Once you have opened your account, you will become a member of the Catergate.com marketplace and will be able to publish your services as well as bid for published events.
Catergate will charge a commission of 7% plus VAT on the services sold for each pay as you go supplier account, which will be used to maintain the marketplace, networks and online advertising.
It is understood that in each case the responsibility for the service and its delivery shall be solely that of the seller.
The seller is free at any time to unsubscribe from the platform after payment of all accrued commission debts, if any. Sellers acting in a professional capacity must clearly indicate this and expressly comply with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, Organic Law 15/1999 on data protection and its implementing regulations, and other complementary regulations.
Responsibilities of a Supplier Account Holder
Each virtual supplier account on the Catergate.com platform is responsible for its own commercial transactions and will establish its own conditions, which in no case may contradict the general rules of the platform.
Maintenance of the Platform
The maintenance of the Catergate.com platform may hinder access to the platform. Maintenance measures shall be carried out in such a way as to avoid, as far as possible, any inconvenience to members. Regular or planned maintenance work shall be carried out at off-peak times and, in case of a longer duration, well in advance. In addition, maintenance measures may be carried out without prior notice, e.g. if unforeseeable faults [viruses, etc.] so require. A certain availability of the Catergate.com platform is not guaranteed.
